Appeals/Complex Motions Attorney –Remote Position

Our client, an established and successful law firm specializing and focusing its practice solely on LITIGATION.
They are looking for an experienced Attorney to work remotely writing and preparing complex motions for senior or junior partners in the practice, including dispositive pre-trial and other motions, motions in limine and post-trial motions. In addition, the Attorney will focus on the area of appeals which includes preparing the record and writing briefs on the appellant side as well as opposing the appellant's brief on the respondent side.
Roles & Responsibilities
Responsibilities include, but are not limited to:
•Communicate with partners in the firm regarding motion and appeal assignments, including when work is needed and scope/objective of assignment.
•Docket and monitor filing/return due dates, obtain extensions of time as required or allowed.
•Communicate potentially with clients, fact and/or expert witnesses regarding the preparation of affirmations or affidavits if needed in support of motions.
•Communicate potentially with clients, colleagues, judges, and others involved in the case.
•Interpret laws, rulings, and regulations for clients, colleagues, judges, and others involved in the case.
•Develop legal strategies and arguments based on the law and facts of the case.
•Maintain knowledge and understanding of current laws and legal updates pertaining to firm's area of practice.
•For pre-trial motions, review and analyze file documents in DMS and/or electronic court docket(s), including client and insurance carrier communications, communications with fact and/or expert witnesses, underlying claim investigation materials, pertinent prior motion practice, relevant court orders and decisions, important written discovery material as well as deposition testimony and exhibits, and any other necessary documentary or other information, research and analyze case law required to advocate motion, draft attorney, fact and/or expert witness affirmations or affidavits if needed in support of motions, draft persuasive memoranda of law and/or assist attorneys in framing arguments for the court.
•For motions in limine, research and analyze case law, draft attorney, fact and/or expert witness affirmations or affidavits and/or persuasive memoranda of law on evidentiary or other issues, assist trial counsel in framing evidentiary or other required issues at trial, assist trial counsel in framing issues for argument and in preserving the record for appeal.
•For post-trial motions, review and analyze trial records, evidence admitted/not admitted, as well as other required documents, research and analyze case law, draft attorney, fact and/or expert witness affirmations or affidavits and/or persuasive memoranda of law on errors in trial in support of judgment in lieu of verdict or new trial, assist trial counsel in framing issues for argument and in preserving the record for appeal.
•For appeals, review and analyze motion and trial records, research and analyze case law, draft persuasive brief that articulates creative, but sound legal arguments for reversal or affirmance of trial court Decision and Order or jury verdict, assist counsel in framing issues for oral argument.
•The position requires attention to detail, careful legal research, excellent and persuasive writing, efficient and timely completion of affirmations, affidavits, briefs and memoranda of law.


•Juris Doctor from accredited law school
•Member in good standing of the NY Bar
•Experience arguing motions and appeals before NYS trial and appellate courts
•Exceptional communication, research, and writing skills
•Significant and demonstrated understanding of civil litigation with an emphasis on burdens of proof in motion and appellate practice
•Excellent organizational skills with strong attention to detail
•Ability to work independently in a remote capacity, yet still be part of a team
•Strong computer skills, must be proficient with Westlaw, Microsoft Office Suite
